Terms of Service
These Terms of Service (“Terms”) govern your use of the SMS/MMS messaging service operated by Maik3r (“we,” “us”). By using the Service, you agree to these Terms.
Service description
Maik3r provides a text-message-based assistant for small general contractors and their field workers. Participants may send photos of receipts, reply to labor reminders, and receive invoice notifications via SMS or MMS.
Eligibility
You must be at least 18 years old to use the Service. You must have been onboarded by a participating contractor who is your employer or engaging party, and you must have authority to receive business-related messages at the phone number you provide.
Messaging consent
By participating in the Service, you consent to receive SMS and MMS messages from the Service number, including confirmations, reminders, and invoice notifications. Message frequency varies. Message and data rates may apply. You may reply STOP at any time to opt out and HELP for help.
Acceptable use
You agree not to:
- Use the Service to transmit any content that is unlawful, harassing, or infringes on others’ rights.
- Attempt to interfere with, disrupt, or gain unauthorized access to the Service.
- Use the Service to send messages unrelated to the contractor relationship for which you were onboarded.
Accuracy of information
The Service uses optical character recognition and other automated processing to interpret the photos and messages you send. You are responsible for reviewing the information logged on your behalf (including via the FIX reply command) and correcting any errors.
Third-party services
The Service is delivered using third-party platforms (including Twilio for SMS delivery and Anthropic for message processing). Their availability and limits may affect your use of the Service. We are not responsible for third-party outages or changes.
Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.
Limitation of liability
To the fullest extent permitted by law, Maik3r, Sasha Spokes, and any affiliates shall not be liable for any indirect, incidental, special, or consequential damages arising out of or relating to your use of the Service. Our total liability for any claim shall not exceed the amount you paid, if any, for the Service in the twelve months preceding the claim.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time by replying STOP.
Changes to the Terms
We may update these Terms from time to time. Updated Terms will be posted at this URL with a new Effective date.
Governing law
These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising out of these Terms shall be brought in the state or federal courts located in Los Angeles County, California.
